Dorothy Lightbourne, who piloted the Bill on Friday (July 3), said that investigations by the Ministry of Labour and Social Security have revealed incidents that occur in factories, including fatalities, which are very often due to flagrant breaches of the law.She noted that even though there are currently 2,134 factories registered under the Act, estimates provided by the Labour and Social Security Ministry indicate that over 600 of them are unregistered.“These unregistered factories usually flout the requirements of the Act. Further investigations, carried out by officers at the Ministry, also revealed that there are many registered factories that also fail to comply with the requirements of the Act and Regulations which seek to ensure the safety of workers,” she stated.Minister of National Security, Senator Dwight Nelson (standing), making comments on the Factories Amendment Act 2009, which was tabled in the Senate on July 3, by Attorney General and Minister of Justice, Senator Dorothy Lightbourne (to Senator Nelson’s left). The Act has not been amended since 1968, and fines include a $200 penalty for obstructing an inspector in the execution of his duties.“These inadequate penalties do not act as deterrent and are certainly not punitive. This Bill is proposing to go some way towards remedying the situation,” she pointed out.Opposition Senator Mark Golding, however, suggested the provision of cease and desist orders, which the factories inspectorate could issue when factories are non-compliant.“I would like to see, in this legislation, the opportunity taken to introduce more flexibility in the type of sanctions and approaches that can be taken, where there is non-compliance,” he said.He explained that a cease and desist order would be useful, if a factory is operating in a way which may be endangering workers, to allow the inspector to be able to lock it down, or suspend operations until the problem is corrected, rather than prosecution.Minister of National Security, Senator the Hon. Dwight Nelson, was concerned about the number of unregistered factories, pointing out that a combination of 10 or more workers could be involved in a “backyard” operation denoted as a factory, according to the Act.“It is in these areas, primarily, in these backyard operations, that we find the significant safety breaches, that we find machines operating without adequate protective devices, that we find that there is no protection against excessive noise,” he said.He added that, in a lot of cases, there was no adequate provision of sanitary facilities, as per the number of workers employed.He also agreed with Senator Golding that, in these situations, there should be some provision in the authority of the factory inspectorate, or the Permanent Secretary in the Ministry, to ensure that operations cease.Senator Lightbourne responded that a comprehensive review is being undertaken to deal with safety in the workplace through the proposed Occupational Safety and Health Act, which is being drafted. No Wage Increases for Public Sector Workers – Minister Dalley

Horace Dalley, has stated that no new wage increases have been granted to any member of the public sector, including parliamentarians and ministers.Mr. Dalley, in his Sectoral Debate presentation in the House of Representatives on Tuesday, July 2, said there has not been any increase in salaries to public sector employees, including parliamentarians, since April 1, 2008.The Minister, who has responsibility for the Public Service, was responding to questions tabled in the Senate some two weeks ago by Opposition Senator, Robert Montague, regarding whether government ministers and other members of parliament (MPs) had benefited from salary increases since January 2012.Mr. Dalley, in describing Senator Montague’s questions as “mischievous”, reminded the House that the wage agreement for the 2008/2010 contract period provided for a 15 per cent salary increase in year one and a further seven per cent in year two.While the first year’s payment of 15 per cent was made in accordance with the agreement, the seven per cent for year two was not paid as agreed, due to a freeze on wages of public sector workers.Mr. Dalley said after much agitation by the workers and their representatives, agreement was reached in 2011, for the payment of the outstanding seven per cent.“The agreement was signed on behalf of the Government by the then Prime Minister, Bruce Golding, the then Minister of Finance, Audley Shaw, and Senator Arthur Williams, then Minister without Portfolio in the Cabinet Office,” he informed.Under the agreement, “payment will commence in September 2011, with the retroactive amount for the month of April 2011 paid in September 2011, and the amount for the months of May to August 2011 paid in December 2011,” he outlined.The agreement also stipulated that “outstanding arrears for the period April 1, 2009 to March 31, 2011, will be made as a ‘one off’ payment (as agreed by the parties) paid in five equal installments in May 2012, October 2012, May 2013, October 2013, and May 2014”.“This is what this new Portia Simpson Miller government is honouring and they are the same rates that were signed by Bruce Golding, Audley Shaw and Arthur Williams in their 2011 Heads of Agreement,” he stated.Contact: Chris Pattersonlast_img read more

Grand chief in New Brunswick says theyll oppose risky pipeline

first_imgThe Canadian PressFREDERICTON – The chief of the Wolastoq Grand Council in New Brunswick says the proposed Energy East pipeline project poses too great a risk to provincial waterways, and the council will oppose it. Grand Chief Ron Tremblay says the council has called a news conference for Monday where clanmothers and other members of the council will discuss their responsibility to protect their non-ceded homeland. “It’s too risky, especially the number of times it will be passing through the St. John River, plus the other tributaries and brooks and streams. It’s too risky for us to agree to a project like that,” Tremblay said Friday. The proposed $15.7-billion Energy East pipeline project would see western crude transported as far as the Irving Oil refinery and a proposed export terminal in Saint John, N.B. The Grand Council claims Indigenous title over the lands and waters of the entire St. John River watershed between the St. Lawrence River and the Bay of Fundy. Tremblay says their ancestors signed peace and friendship treaties with the British Crown but never surrendered or sold any of their land. In a submission to the National Energy Board last year, the council said the proposed route of the pipeline would cross rivers, lakes and streams at least 185 times. “We’re always looking at the protection of our waterways and lands for our children and grandchildren and the next seven generations,” Tremblay said. While Tremblay said they will oppose the pipeline, it’s too early to say how they might do that. It is just the latest public comment in opposition to the project, coming on the heels of strong condemnation from Montreal-mayors last month. New Brunswick Premier Brian Gallant has been a strong proponent of the pipeline and says it offers a safer way to move the oil than by rail. Western oil producers who are looking for ways to export their oil met in Calgary with Prime Minister Justin Trudeau, pressing him to do what it takes to get pipelines built to move Alberta oil to the east and west coasts, where it would be loaded onto tankers bound for foreign markets. Trudeau told the executives it’s up to the National Energy Board to decide the fate of pipeline proposals, and he wasn’t about to prejudge any decision the board might make.last_img read more
